There is a new law in Utah that passed this month, one that provides a discount price on marriage licenses for engaged couples who participate in relationship education classes. The state, known for its desire to keep divorce rates low, hopes to strengthen marriages from their outset.

There is nothing wrong with that.

When you are in love and get married, the farthest thing from your mind is divorce.

Unfortunately, we know it happens despite our best efforts to make things work. Whether couples are just incompatible or infidelity is involved, sometimes divorce is necessary.

In Utah, there are around 23,000 marriages a year. Out of those, the Utah Marriage Commission says approximately 10,000 will end in divorce. If you need a divorce attorney in Salt Lake City, Emy A. Cordano, Attorney at Law, is here to help.

What Happens In A Divorce?

The better question is, what doesn’t happen in a divorce?

Divorce proceedings can become complex, especially in Utah. In this state, before a divorce proceeding can proceed, the two parties must go through at least one mediation session which must be paid for by both parties. This is law in Utah, and it is required in the hopes that the parties will be able to work out their differences, making the divorce unnecessary.

After the mediation, if the parties still wish to proceed with the divorce, you will need legal assistance.

Alimony

The court may require one spouse to pay the other spouse money so they can maintain a lifestyle that was close to what they experienced during the marriage. Many factors go into determining alimony payments, such as:

  • The length of the marriage
  • Child custody arrangements
  • Income of both spouses
  • Factors leading to the divorce

Alimony can be adjusted based on income changes of either party or if the spouse who receives alimony remarries.

Child Custody

When a couple has children, divorce proceedings can become even more difficult. The court will do everything they can to ensure that the child’s best interests are considered. There are different types of custody:

  • Legal custody – which parent has the right to make legal decisions on matters impacting the child.
  • Physical custody – which parent will the child reside with.

For both types of custody, there can be a mix of joint or sole custody between the parents. These decisions can become complex and emotional for all parties involved.

Other Issues

If there are any assets to be divided, you will need experienced legal assistance to handle it. Property and finances will need to be divided and you want to make sure it is done fairly.
